Terms of Service

1. Acceptance of Terms

By accessing or using Bespoke Mixology, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. Your use of the Service constitutes acceptance of both documents.

These Terms also serve as the end-user license agreement between you and Bespoke Mixology for the mobile application. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the application on devices you own or control, for your personal, non-commercial use. If you obtained the application from the Apple App Store or Google Play, your use is also subject to that store’s applicable terms, and those terms prevail over these Terms to the extent of any conflict.

2. Eligibility and Age Requirement

Bespoke Mixology is an adults-only Service. You must be at least 18 years of age to create an account or use the Service, and we ask for your date of birth at sign-up to confirm eligibility. By using the Service, you represent and warrant that you meet this requirement. While anyone 18 or older may use the Service to explore, create, and learn about beverages, you must be of legal drinking age in your country, state, or region to purchase, prepare, or consume alcoholic beverages. The Service provides information about alcoholic beverages and is intended solely for lawful, responsible, adult use, and nothing in the Service should be taken as encouragement to drink alcohol below your local legal drinking age.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Please provide accurate information, keep it up to date, and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

You may also sign in using device-based credentials such as a passkey, fingerprint, or face recognition. These credentials are tied to the device you set them up on, and you are responsible for securing that device and for any activity by anyone who can unlock it. If your device is lost, shared, or compromised, remove the credential from your Profile and notify us promptly.

You may be signed in on up to five devices at a time. If you sign in on a sixth device, the device you used least recently is automatically signed out. For your security, sessions also expire after a period of inactivity, and you will need to sign in again. You can view your active sessions, and sign out of individual devices or all other devices, from your Profile.

4. Subscriptions, Billing, and Renewal

A free account lets you explore the Service. Some features require a paid Master Mixologist subscription. The plan name, duration, and full price are always shown to you on the purchase screen before you buy, and those displayed terms govern your purchase.

Free trial. New subscribers may be offered a 14-day free trial. If you do not cancel before the trial ends, the trial converts automatically into a paid subscription and the first charge is taken at that time. Cancelling at any point during the trial means you are not charged.

Automatic renewal. The subscription is billed annually and renews automatically at the then-current annual rate at the end of each period, unless you cancel at least 24 hours before the end of the current period. Your subscription continues to renew until you cancel it.

Price changes. We may change the subscription price from time to time. Where a change would increase what you pay, you will be notified in advance, and where your app store requires it, you will be asked to approve the new price before it is charged. If you do not approve an increase, your subscription will not renew at the new price and will instead end at the close of your current period. Notice periods and approval requirements are set by the applicable app store and may differ between the Apple App Store and Google Play. Price reductions may be applied without separate approval.

Purchases made through an app store. If you subscribe inside the iOS or Android application, your purchase is processed by Apple or Google rather than by us, and is subject to that store’s terms and payment policies. Those subscriptions must be cancelled through the store’s own subscription settings — Apple ID → Subscriptions, or Google Play → Subscriptions — and cancelling the app or deleting your account does not by itself cancel a store subscription. Refund requests for store purchases are handled by the applicable store under its refund policy, not by us. If you subscribed on the web, you can manage or cancel your subscription from Profile → Subscription, and payments are processed securely by our third-party payment processor.

Restoring a purchase. If you reinstall the application or move to a new device, you can use the Restore Purchases option on the Subscription page to re-associate an existing app store subscription with your account.

Access codes. We may issue complimentary access codes granting subscription features for a limited period. Access codes are not purchases, carry no cash value, do not renew automatically, and may be limited, suspended, or revoked if they are shared, resold, or otherwise misused.

Cancellation stops future charges; your access continues until the end of the period you have already paid for. Except where required by law or by the applicable app store’s policy, payments are non-refundable, and we do not provide partial refunds for unused portions of a period.

5. Acceptable Use and Prohibited Content

You agree not to misuse the Service. This includes not violating any law, not infringing others’ rights, not harassing or threatening other members, not attempting to disrupt or reverse-engineer the Service, and not using it to promote irresponsible or underage drinking.

You must not upload, post, share, or transmit content that is unlawful, harmful, or objectionable. Prohibited content includes, without limitation: sexually explicit or pornographic material; content that sexualizes, exploits, or endangers minors; graphic violence or gore; hate speech or content that harasses, threatens, or promotes discrimination or violence against others; content that promotes self-harm, dangerous, or illegal activity; spam, scams, or deceptive content; and content that infringes intellectual property or privacy rights. This Service is not intended for and must not be used to create or distribute content directed at, or depicting, minors.

6. Your Content

You retain ownership of the recipes, photos, posts, and other content you manually add or import. By sharing content on the Service, you grant Bespoke Mixology a non-exclusive, worldwide, royalty-free license to host, store, display, use, and distribute that content solely to operate and improve the Service and, where you choose, to make it visible to other members. You are responsible for the content you share and confirm you have the right to share it.

Marquee Recipes. Creating a Marquee Recipe is a subscriber feature. When you share or post a Marquee Recipe, other members may save it, and they may keep, view, and share their saved copy. If your subscription ends you keep the Marquee Recipes you created and may remove them from your own library, but you can no longer create, edit, or post them until you subscribe again; copies already saved by other members are unaffected. If you delete a Marquee Recipe you created, it is removed for everyone who saved it.

7. Community and Social Conduct

When using the Feed, friends, messaging, and public profiles, treat others with respect. Do not post content that is unlawful, hateful, deceptive, or infringing. We have zero tolerance for objectionable content and abusive behavior. We actively moderate the Service and will remove violating content and restrict, suspend, or terminate accounts that break these rules to keep the community safe.

8. Content Moderation, Reporting, and Enforcement

We use a combination of automated screening and human review to help keep the Service safe. Content you submit — including text, images, and video across posts, profiles, shared recipes, and messages — may be automatically screened, and content that appears to violate these Terms may be blocked, hidden, or removed, in some cases before it is published.

You can help by reporting content or accounts you believe violate these Terms using the report option available throughout the Service. We act on every report: our team reviews reported content and takes appropriate action, and we aim to review and resolve reports of objectionable content within 24 hours. Please report responsibly; submitting knowingly false or abusive reports is itself a violation of these Terms.

When content or conduct violates these Terms, we take action, including removing or hiding content, issuing warnings or strikes against an account, and limiting, suspending, or terminating access. We remove objectionable content and eject users who post it. Repeated or serious violations result in permanent removal from the Service. Where we believe content involves illegal activity — including any content that exploits or endangers minors — we report it to the appropriate authorities. We are committed to keeping the Service free of objectionable content and abusive users, and we act on reports promptly.

9. AI-Generated Content and Recipe Disclaimer

Recommendations, recipes, substitutions, and other outputs may be generated by artificial intelligence and, where practical, are labeled as AI-generated within the Service. They are provided for general informational and entertainment purposes only, may contain errors, and are not professional, medical, dietary, or safety advice. Always verify ingredients, measurements, and preparation — especially regarding allergens, food safety, and alcohol content — and use your own judgment. If you believe AI-generated content is inappropriate or violates these Terms, you can report it using the report option. Please drink responsibly and never drink and drive.

10. Store and Third-Party Links

The Store and other areas may feature products and links to third-party retailers, some of which may be affiliate links. We do not sell these products directly and are not responsible for third-party sites, their content, pricing, availability, or policies. Purchases you make from third parties are governed by their terms.

11. Intellectual Property

The Service, including its design, features, text, graphics, and logos, is owned by Bespoke Mixology and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted by these Terms.

12. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

13. Limitation of Liability

To the fullest extent permitted by law, Bespoke Mixology and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Service or reliance on AI-generated content. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

14. Indemnification

You agree to indemnify and hold harmless Bespoke Mixology and its operators from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or the rights of others.

15. Termination

You may stop using the Service and close your account at any time. You can permanently delete your account, and the data associated with it, from your Profile page. If you no longer have the app installed, you can request deletion at bespokemixology.ai/delete-account — no sign-in is required. Deleting your account does not cancel a subscription purchased through the Apple App Store or Google Play — those must be cancelled separately in the store’s subscription settings, as described in section 4.

We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will continue to apply.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you within the Service. Your continued use after changes take effect means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in the Commonwealth of Virginia, unless applicable law requires otherwise.
